Terms of service

Last updated: 24 September 2026

These terms explain how you can use our website and buy products from us. Please read them before placing an order. Part A applies to everyone. Part B applies only if you are a consumer. Part C applies only if you are a business customer.

Nothing in these terms affects your legal rights as a consumer.

Part A: Terms for all customers

1. About us

Bdybud is a trading name of Tobias White, a sole trader.

  • Address: 5 Wates Yard, 82 Mitcham Lane, London SW16 6NR, United Kingdom
  • Email: tobias@bdybud.com
  • Telephone: +44 7450 638181

In these terms, "we", "us" and "our" mean Tobias White trading as Bdybud. "You" means the person or business buying from us or using our website.

If we need to contact you, we will do so by email or telephone using the details you gave us when you placed your order.

2. Consumers and business customers

You are a consumer if you are an individual buying wholly or mainly for purposes outside your trade, business, craft or profession.

You are a business customer if you are buying for the purposes of your trade, business, craft or profession, for example as a bodyshop, garage, smart repairer or detailer. If you tell us at checkout or in your account that you are buying for a business, or you give a business name, we will treat you as a business customer.

Consumers have extra legal rights, set out in Part B. Some of those rights, including the right to cancel for a change of mind, do not apply to business customers.

3. Age-restricted products

Some of our products, including aerosol paints, primers, solvents, thinners, hardeners and other chemical products, are age restricted. You must be 18 or over to buy these products, and they are marked as age restricted on the product page. By ordering an age-restricted product, you confirm you are 18 or over. We may ask for proof of age and may cancel any order for an age-restricted product where we reasonably believe the buyer is under 18.

4. Using our website

You may use our website for lawful purposes only. You must not use it to commit fraud, to introduce viruses or harmful code, to interfere with its security or operation, or to copy or scrape its content without our permission. We may suspend or restrict access if we reasonably believe these terms have been breached.

If you create an account, you are responsible for keeping your login details secure.

5. Our products

We aim to describe and show our products accurately. Images and colours may vary slightly depending on your screen, and manufacturers may change packaging without notice.

Many of our products are professional automotive refinishing products and some are hazardous. Where a product carries hazard warnings, we show the hazard information on the product page. Safety data sheets are available on request from tobias@bdybud.com.

You are responsible for choosing products suitable for your intended use and for using, storing and disposing of them safely, following the manufacturer's instructions, labels and safety data sheets.

6. Orders

To order, add products to your basket, go to checkout, enter your details and choose a delivery and payment method. Before you place your order, you can review everything and correct any errors, including by changing quantities or removing items. Orders are concluded in English only. We send you an order confirmation by email, which includes a link to these terms; we keep a record of your order, and you can view it in your account if you have one.

When you place an order, you are offering to buy the products in your basket. A contract is formed when we email you to confirm we have accepted your order, or when we dispatch the products, whichever happens first.

We may decline or cancel an order before it is accepted, or cancel an accepted order and refund you in full, where:

  • a product is unavailable;
  • the price or description was clearly wrong;
  • payment is not authorised;
  • we reasonably suspect fraud;
  • the delivery address or product cannot be served because of transport restrictions on hazardous goods; or
  • the age restriction in section 3 has not been met.

7. Prices and payment

Prices are in pounds sterling and include any VAT that applies. Delivery charges are shown at checkout before you place your order.

All customers, including business customers, pay in full at checkout. We do not offer credit accounts unless we have agreed this with you in writing.

If we discover an obvious pricing error after you order, we will contact you to ask whether you want to continue at the correct price or cancel for a full refund.

8. Delivery

Our delivery areas, options and estimated timescales are set out in our Shipping Policy and at checkout. Unless we agree a delivery date with you, we will deliver without undue delay and in any event within 30 days of accepting your order.

The products are your responsibility from the time they are delivered to the address you gave us, or to a person or safe place you nominated. Ownership passes to you when we have received full payment.

Some hazardous products can only be sent by certain couriers or services. If we cannot deliver an item to your address, we will contact you to agree an alternative or give you a full refund for that item.

9. Reviews and feedback

If you submit a review or feedback, it must be honest, based on your genuine experience and lawful. We do not publish fake reviews or pay for positive ones, and we do not suppress genuine negative reviews. You give us permission to display and use your review and feedback in connection with our business.

10. Intellectual property

The content of our website, including text, images, logos and design, belongs to us or our licensors. You may use it only to browse and buy from our website.

11. Privacy

We use your personal information as described in our Privacy Policy.

12. Our website platform and third parties

Our website is hosted by Shopify, and payments may be handled by third-party providers such as Shopify Payments, PayPal and Klarna, which have their own terms. Your contract for products is with us, not with those providers.

13. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. If this happens, we will contact you as soon as possible and take reasonable steps to minimise the delay. If there is a risk of substantial delay, you may contact us to cancel and receive a refund for products you have paid for but not received.

14. Changes to these terms

We may update these terms from time to time. The terms that apply to your order are the ones shown on our website when you placed it.

Part B: Additional terms for consumers

15. Your right to cancel

If you are a consumer, you have the legal right to cancel your order for any reason within 14 days of the day you (or someone you nominate) receive the products. If your order arrives in separate deliveries, the 14 days run from the day you receive the last one.

To cancel, tell us clearly within that period, for example by emailing tobias@bdybud.com. You can use the model cancellation form in our Refund Policy, but you do not have to.

You must then send the products back to us within 14 days of telling us you are cancelling. Our Refund Policy explains how. Unless the products are faulty or not as described, you pay the cost of returning them.

We will refund the price of the products and the standard delivery charge you paid, within 14 days of receiving the products back or, if earlier, of receiving your evidence that you have sent them. We will refund using the payment method you used.

You may handle the products as you would in a shop. If you handle them more than that and this reduces their value, we may reduce your refund to reflect the loss in value.

16. When the right to cancel does not apply

The right to cancel does not apply to:

  • sealed products that are not suitable for return for health protection or hygiene reasons once unsealed, such as respirators, masks, filters and disposable PPE, if you have unsealed them;
  • products that, by their nature, have become inseparably mixed with other items after delivery; and
  • products made to your specification or clearly personalised, such as paint mixed to your colour code.

17. Faulty products

As a consumer, you have legal rights if a product is faulty or not as described. In summary:

  • Within 30 days of delivery, you can reject the product and get a full refund.
  • Within 6 months of delivery, if a fault appears, you are entitled to a repair or replacement. If that is not possible or does not work, you can get a refund.
  • Up to 6 years after delivery, you may be entitled to a repair or replacement, or a refund or price reduction, although you may need to show that the fault existed at delivery.

These rights come from the Consumer Rights Act 2015. For more information, visit the Citizens Advice website or call 0808 223 1133.

If a product is faulty or not as described, we pay the reasonable cost of returning it.

18. Our responsibility to consumers

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen, or if we both knew it might happen when the contract was made.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products, or for defective products under the Consumer Protection Act 1987.

We supply products for domestic and private use. If you are a consumer and use the products for business purposes, we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.

Part C: Additional terms for business customers

19. How Part C applies

This Part applies if you buy as a business customer. Where anything in Part C conflicts with Part A, Part C applies.

The consumer rights in Part B, including the right to cancel for a change of mind, do not apply to business customers. We may accept a return of unused, unopened products at our discretion, and may charge a reasonable restocking fee if we do.

20. Checking your delivery

You must check each delivery on arrival and tell us about any damage, shortage or wrong item within 7 days of delivery. You must tell us about any other defect within a reasonable time after you discover it, and in any event within 3 months of delivery.

21. Faulty or incorrect products

We promise that, on delivery, the products will match their description and be of satisfactory quality. If a product does not meet this promise and you tell us in time, we will, at our choice, repair or replace it, or refund the price you paid for it.

This promise does not cover defects caused by fair wear and tear, misuse, incorrect storage or application, failure to follow the manufacturer's instructions or safety data sheets, or use beyond the product's stated shelf life.

Except as set out in these terms, and to the extent permitted by law, all other terms implied by law about the quality or fitness for purpose of the products are excluded.

22. Your responsibilities

You are responsible for ensuring that the products are used, stored and disposed of only by suitably trained people, and in accordance with applicable health and safety law (including COSHH), the manufacturer's instructions and the safety data sheets.

23. Limits on our liability to business customers

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title to goods), for defective products under the Consumer Protection Act 1987, or for anything else that cannot be limited or excluded by law.

Subject to that, we are not liable to business customers for any loss of profit, loss of sales or business, loss of goodwill, business interruption, or any indirect or consequential loss. Our total liability to you for all claims arising from an order is limited to the total price you paid for that order.

24. Late payment

If we agree in writing to give you credit, invoices are payable within the period we agree, and we may charge interest on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.

Part D: General

25. Other important terms

If a court finds part of these terms unenforceable, the rest will still apply. If we do not enforce our rights immediately, we can still enforce them later. Nobody other than you and us has any right to enforce these terms. We may transfer our rights and obligations under these terms to another organisation, and will tell you if this happens. For business customers, these terms are the whole agreement between us about each order.

26. Law and disputes

These terms are governed by the law of England and Wales. If you are a consumer, you can bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of the country where you live. Business customers agree to the exclusive jurisdiction of the courts of England and Wales.

If you have a complaint, please contact us first at tobias@bdybud.com. We aim to resolve complaints quickly and fairly.
